1.1. Fenix Logistics Group LLC is a logistics brokerage that connects customers with licensed and insured carriers for vehicle and freight transportation.
 

1.2. We do not own or operate transport vehicles. We act solely as an intermediary between customers and third-party carriers.
 

1.3. By booking a shipment with us, you agree to these Terms and Conditions.

2. Services Offered

2.1. We provide brokerage services for vehicle and general freight transportation, connecting customers with third-party carriers.
 

2.2. Services include but are not limited to: open and enclosed vehicle transport, freight shipping (FTL/LTL), and expedited logistics.
 

2.3. We reserve the right to modify or discontinue services at any time without prior notice.

3. Quotes, Booking & Payment

3.1. Quotes provided are based on current market rates and are subject to change until booking confirmation.
 

3.2. A deposit or full payment may be required before dispatching a carrier. Payment methods accepted include Zelle, Cash App and ACH.
 

3.3. Cancellations may be subject to fees based on the booking status and carrier assignment.

4. Shipment Process

4.1. Pickup and delivery dates are estimated and not guaranteed, as delays may occur due to weather, traffic, or mechanical issues.
 

4.2. Customers must provide accurate shipment details, including pickup and delivery locations. Incorrect information may result in additional charges.
 

4.3. Shipments must be prepared in accordance with transport requirements. Vehicles should be in operable condition unless otherwise arranged.

5. Liability & Insurance

5.1. All carriers in our network are required to maintain insurance coverage for transported shipments.
 

5.2. Fenix Logistics Group LLC is not liable for damage, delays, or losses caused by third-party carriers. Claims must be filed directly with the carrier.
 

5.3. Customers are responsible for inspecting shipments upon delivery and reporting any damage immediately.

6. Cancellations & Refunds

6.1. If a shipment is canceled before a carrier is assigned, a full or partial refund may be available.
 

6.2. Cancellations after carrier dispatch may result in a non-refundable deposit or cancellation fee.
 

6.3. Refund requests must be submitted in writing to admin@fenixlogisticsgroup.com.

7. Customer Responsibilities

7.1. Customers must provide accurate shipment details to ensure proper service.
 

7.2. Any modifications (e.g., added cargo, size changes, location updates) may result in additional charges.
 

7.3. The customer must be present or have an authorized representative available at pickup and delivery.

8. Disclaimers & Limitation of Liability

8.1. Fenix Logistics Group LLC is not responsible for delays, damages, or losses caused by third-party carriers, weather, or unforeseen circumstances.
 

8.2. We are not liable for pre-existing damage, mechanical issues, or tire conditions of vehicles transported.
 

8.3. Our liability is limited to the amount paid for the brokerage service and does not cover indirect or consequential damages.

9. Data Policies

9.1. Information Collection: We collect only the necessary personal data to provide and improve our services, including names, email addresses, and phone numbers.
 

9.2. Use of Information: Your information is used solely for communication, service updates, and shipment processing. We do not sell, rent, or share personal data with third parties.
 

9.3. Data Security: We implement industry-standard security measures to protect your information from unauthorized access or disclosure.
 

9.4. SMS & Communication Policy: By reaching out to us via SMS, you agree to receive service-related messages. You can opt-out by replying STOP. No mobile or messaging consent information will be shared with third parties for marketing purposes.
 

9.5. Third-Party Data Sharing: We do not share personal data with third parties except when legally required, such as responding to subpoenas, enforcing terms, or investigating fraudulent activities.
 

9.6. International Data Transfers: Your information may be processed in locations outside of your jurisdiction, subject to applicable data protection laws.
 

9.7. Data Retention: We retain personal data only as long as necessary to fulfill service obligations, comply with legal requirements, and resolve disputes.

10. Governing Law & Dispute Resolution
